this is my favorite part:
I never defended the idea that they went bankrupt. People (such as angry) have been trying to spin this thread that anything and everything that's happened to sierra is a direct result of the Burton fiasco. I simply reject the idea of direct cause-effect relationships between a bunch of disconnected events. |

As I've pointed out - there's no real legal justification for a 'gag' order when it comes to bankruptcy proceedings. The only reason why there would be any kind of gag order is if there's more going on then simple bankruptcy... but hey - what do I know, i'm just an 'over zealous ex employee' ![]() |

are you trying to call me a communist? ![]() On a more serious note - thus far, i've said the following: 1) That not everything that's happened with sierra has been a result of Burton. 2) That people trying to make everything out to be because of Burton don't understand the whole picture. 3) That If sierra files for bankruptcy - it will become public information, and there won't be a need to speculate about it. 4) That if sierra files for bankruptcy, it's likely part of something bigger going on. thus far - despite what some people might like to guess about - I'm not aware anyone's proven anything i've said to be wrong. |

Obviously I'm jumping in late, but, are there talks of Sierra going under? I appoligize if I'm way off. Just read the posts and the bankruptcy thing doesn't sound too promissing. I guess I'll be buying more within the next few weeks than I had planned. I hope everything works out for the best for Sierra regardless of whatever happens.

Ok cool lets speculate......... while taking no sides.
SS and Burton had a contract dispute. SS decides not to pay Burton. Burton Sues SS. SS declares bankruptcy to not have to pay for the settlement.......... and then SS open again under MAM 2010 inc. or something like that. |

Like I said speculation...... only reason I wrote this is a similar thing happened within the Tool industry in Canada. Company "A" got sued, filed for bankruptcy, sold off all assets at pennies on the dollar to themselves under a different company name and re-opened within 6 months. I am sure there was way more to it than that but thats how it worked out in the end.

There's been some changes in the laws over the years that make that a little more difficult to do. Nevermind that chapter 11 is reorganization of an existing company. What you're talking about would require chapter 7 which is liquidation... |

I've avoided speaking what i really think is going on - but f'it - here goes.
What I think happened: 1) Burton and Sierra have a contract dispute (we know this). 2) Burton pulls retail agreement. 3) dickwaving ensues on both sides. This includes things like massive sales, international shipping, etc. This also includes things like Burton demanding payment in full for all product - as is their right under the agreement that was pulled, but also isn't always customary. Lots of legal stuff that will probably never see the light of day. Generally speaking when agreements like this go south - Burton would just back a truck up and take back all the product, and issue a refund minus a 'restocking fee' of sorts (20% I believe?). Again - all part of the retail agreement. The fact that burton didn't back a truck up - tells me that they demanded payment. That's kind of a dick-waving move. Now Sierra (MAM/Sierra = same thing) filed Chapter 11 in response to the lawsuit. Does that mean Sierra is going out of business? No - that's a way of waving a dick back at Burton and saying "oh - you want what we have? guess what - we don't got crap go ahead and come and get it". This is a fairly typical legal maneuver. Chances are - there's a counter suit of some sort waiting in the wings that has yet to be filed, and bankruptcy is simply part of the legal strategy of dealing with the Burton/Sierra dispute. |

That's why assertions like Angry's about what is going on and what all this means is off-base. There's a big difference between a chapter 11 filing like this being a consequential result of the burton fiasco, and a filing like this being part of a deliberate response. That's the point i was trying to make when i told him he didn't really get the bigger picture, and he was trying to tie unrelated stuff together (like the move, closing of the retail store, etc) in a way that wasn't accurate. |

Lawyers are good at creating agreements where, although you don't expect that a "I'm gonna pull my d!ck out and slap you" to be used, they put it in there in the event of monies not being transferred for goods or services. It's the political correct way of a threat.

lol@icecoast... thats great that you save up enough money to buy at your local shops.. its always good to support your local shops.. but some people want to save money... mostly because they have other bills to pay that a normal 16 year old doesn't have...
say... a mortgage, gas, water, power, tv, telephone, internet, et al. maybe its the asian in me.. but i try to save money wherever i can... yes i probably could afford to pay retail... but if there's a site that sells it for 50-70% off retail why wouldn't i buy from them? I'm not the kind of person that needs to be the first one with the new gear |

@ MiguelMas. We care so much because Sierra is a great company and it would be a shame, in the event the go under, to see them go. They take care of their customers and sell great products. That's why.
@Icecoast. I'm glad you enjoy paying full price on something you can get at a cheaper price somewhere else. You're not 16; however, if you are, you're spending daddys money so no wonder you don't care wether or not you pay full price. I completely agree with Boxstomper. No I'm not 16 and I'm no Donald Trump, but money is not an object in my household. Who wouldn't want a great deal?
Either way, I hope all goes well for Sierra. Until we know for sure, I'm spending some money on a few extra things just in case.
