No - that's a way of waving a dick back at Burton and saying "oh - you want what we have? guess what - we don't got crap go ahead and come and get it". This is a fairly typical legal maneuver.

Chances are - there's a counter suit of some sort waiting in the wings that has yet to be filed, and bankruptcy is simply part of the legal strategy of dealing with the Burton/Sierra dispute.

This sucks, guys. I wish you all the best and hope things work out. Sierra is an awesome company and really seems to look out for riders with kick-downs and such. Not a whole lot of companies can say that.

Definitely not, look at the US airlines. I think all of them have been in and out of Chapter 11 a number of times.

In other parts of the world though bankruptcy is usually the end. :(

I agree with Dirtydragon.  Buy a ton of stuff before it's gone.  I just told my wife what we are all "speculating" about on here and lucky for me, she agreed that I should spend some money.  Can't argue with that.  Just bought a new insulated jacket and two other lighter weight jackets.  Can't argue with the wife when she says "go ahead" and buy some sutff.  I called Sierra today and spoke with customer service regarding a jacket.  As always, their customer service was top notch and the employee went the extra mile to answer my question.  If they are on their way out (like some of us are speculating), they are still taking care of their customers.  Right on Sierra, thank you.

so i'm hoping for a kick ass july 4th weekend liquidation sale.  I already bought 3 boards but if there is a good sale, I might pick up a couple more boards just in case sierra goes under.  I'll have enough boards to last me like 10 years.

i think sierra applied for chapter 11 bankruptcy which in most cases, means that the company is being reorganized (reorganization of their debts and assets) but in some cases, it could also mean liquidation.

usually chapter 11 is a result of a cash crunch.  Most companies operate on credit when they purchase stock/inventory.  It's possible that due to the breach of contract between Burton and Sierra, Burton has demanded that Sierra pay all that they owe immediately due to breach of contract.  

It is likely that Sierra has a lot of assets that can cover the amount they owe their suppliers but to come up with the money quickly is a problem.  That's when they would file chapter 11 to buy time to get the money they need to pay.

This thread has definitely been interesting to read, that's for sure.  First things first, I think a perma ban on Scorer099 is a bit much, perhaps a week would be more appropriate.  Secondly, many companies have filed Chapter 11, and been just fine.  It's a "reorg" of debt, etc. etc.  Who knows what will come out of it, but I do believe, since Sierra has been mum on it, they are planning on just moving along with day to day operations, as they have been.  Perhaps I'm wrong though.  

Here it's December everyday.

The thing is, even if Sierra IS able to rebound from this, and there's a decent possibility of that, they will no longer be carrying many of the bigger brands that they once carried. The huge price slashes that many of the members have been accustomed to will be a memory. There will be a very different SS than people are accustomed to if they do somehow emerge from this.

However, all the main brands have left, and I seriously doubt they will be doing business again with SS anytime soon, if ever. The brands that are left (and I don't know which ones will decide to continue to do business with SS. Capita? Rome?), SS will have to abide by the vendor agreements, so the prices will be on par with any other online/store vendor you see out there. Food for thought.
 
The main reason I'm getting from reading through posts is that many people bought here due to the prices, which I totally understand, but I'm wondering if those same people will still buy from here when prices are the same at 100 other stores. If you still wanted to support SS due to their community or whatnot, which is a topic in itself, more power to you.

The main reason I'm getting from reading through posts is that many people bought here due to the prices, which I totally understand, but I'm wondering if those same people will still buy from here when prices are the same at 100 other stores. If you still wanted to support SS due to their community or whatnot, which is a topic in itself, more power to you.

Agreed.  This forum,  well I guess even the online store, will take a drastic change.  I can see even some more brands pulling out after this fiasco, but FedEx will stick with em.  They wouldn't be shipping orders right now if SS said screw you, and not think about the future.

SS will be fine... just different & a lot smaller like most board shops.

All my thoughts, so don't quote me on anything if we can't log in next week... haha

wow... there are so many doomsayers on this board...
look even if ss has filed for chapter 11 that doesn't mean a lot of major brands are gonna stay clear of sierra based solely on their filing...
if sierra has previously paid companies like flow and mervin on time and in full then of course they're still going to do business with them...

and who knows.. another company might step in, in burton's absence, to fill the void... i'm sure the inventory and turnover of a company like sierra would be pretty inticing to other companies.. nevermind the online community it has fostered... mind you that is probably wishful thinking...

hope for the best... prepare for the worst...

You DO realize that the 2 biggest companies in the snow industry have already pulled the plug on SS (Burton/K2), and there are rumors of even more companies that have pulled out or are planning on it.
 
Flow isn't considered a major brand. Mervin...maybe.
 
What company could fill in Burton's absense (legit question)? What other company besides K2, who has pulled out, has the manufacturing capacity to fill those orders? Even if a smaller company has said capacity, they might not want to over manufacture their brand.

Like others have said, chapter 11 doesnt usually end in a company disappearing. I think when people hear BANKRUPT, they have that image in their head with the little store all empty with the big out of business sign in the window. Obviously that's not what happens with many bigger companies and corporations. Obviously, it does happen though. But meh, I'm Canadian and I only studied a bit of american business law in our comparative class.

IF sierra does say byebye, it's going to suck for me and all the other international buyers the most. You guys stateside can still buy stuff for a little more but international buyers are potentially paying 50 - 100% the Sierra price.
